US Birth Rate Hits New Low

The rate of babies born in the United States hit a record low in 2011, a new analysis shows. Researchers say the drastic drop in the birth rate among immigrants has greatly contributed to the overall decrease. Based on preliminary data from the National Center for Health Statistics, the Pew Research Center calculated that the overall birth rate — the annual number of births per 1,000 women between 15 to 44 — was 63.2 last year. That's the lowest since such reliable record collection began in 1920 and close to half the birth rate in 1957, amid the Baby Boom years.

Kevin McHale's daughter, Sasha, dies after battle with lupus

Alexandra "Sasha" McHale, the daughter of Houston Rockets coach Kevin McHale, died Saturday afternoon, the team announced. She was 23 years old. McHale took a leave of absence to be with his daughter and family in Minneapolis on Nov. 10. Sasha McHale had battled lupus, an autoimmune disease, and was hospitalized with a related condition, according to the Houston Chronicle, though the team never disclosed the specific reason. "Our entire organization is mourning the McHale family's loss, and we ask that you keep them in your thoughts and prayers." Kelvin Sampson, who is coaching the team in McHale's absence, told reporters last week the situation was improving. “It’s not out of the woods yet. There’s still a lot of concern, but it is improving," Sampson said. The Rockets are 6-7 in their second season with McHale, a Hall of Famer who spent his playing career with the Boston Celtics, at the helm.

'Dirty Jobs' canceled: What's next for host Mike Rowe?

There will be no more "Dirty Jobs" for host Mike Rowe. According to a blog written by Rowe, the Discovery Channel has canceled the pioneering reality show which took him into sewers and mud pits to perform weird, gross, and disgusting work-related tasks. While "Dirty Jobs," which premiered in 2003, was once a ratings success, its numbers have drifted downward over the years. Just last week, Discovery confirmed the cancellation (again) of the once-popular "American Chopper," about a father-son team of bike builders. Discovery did not return a request for comment. With the cancellation, Rowe, 50, can take a break from "exploding toilets, venomous snakes, misadventures in animal husbandry, and feces from every species," he writes in his blog post . Rowe learned the news several weeks ago, but seemed to be in some denial about its demise. "My first instinct was to immediately pass the news on to you, but frankly, it's taken me a few weeks to digest," he blogged, explaining how the show was a "very personal" endeavor for him. Some memorable "Dirty Jobs" of seasons past include: "Pig Farmer" (Aug. 9, 2005): Never say someone lives like a pig. Because they don't. "Alligator Farmer" (Jan. 24, 2006): Rowe tries to catch baby alligators. Uh, they win. "Dirty Jobs of the Big Apple" (April 14, 2008): Anyone who lives in New York City will fully appreciate all the things we take for granted -- like working elevators. "Sheep Castrator" (Oct. 21, 2008): A man bit off a lamb's testicles with his teeth. Enough said. In his blog, Rowe marks Thanksgiving day by expressing his gratitude for the crew and the fans. "Whether we were dangling from bridges, crawling through mines, swimming with sharks, castrating sheep, transplanting giant cacti, or slowly freezing to death on the Arctic Ocean, we usually made it out in one piece, and we always got what we needed," he says of the intrepid cameramen, producers, sound technicians, and others who braved hazardous conditions to film the show. As for the fans, Rowe acknowledges the show wouldn't have existed without them. "In truth, it was really you guys who programmed the show," he notes. "Long after I ran out of ideas for more jobs, it was your suggestions that kept us on the air." It's unclear if Rowe will continue with his other Discovery Channel ventures -- "How Booze Built America," which aired this fall, and narrating "Deadliest Catch," which is currently filming for an April 2013 premiere. Rowe has other irons in the fire -- like appearing in commercials for Ford, Lee Jeans, and Viva paper towels. Earlier this year, he guest starred alongside Tim Allen on the ABC sitcom "Last Man Standing." He also tends MikeRoweWorks.com, a site supporting trade workers. His advocacy for the industry led him to appear at an event with presidential nominee Mitt Romney -- though Rowe later said he didn't intend it as an endorsement. "Good things are in the works," Rowe writes in his blog. "Not as dirty perhaps, but exciting nevertheless."

Stockton man pleads guilty to robbing Bay Area banks

OAKLAND, Calif. — A 22-year-old Stockton man has pleaded guilty in federal court in Oakland to carrying out six bank robberies in the East Bay and Stockton in February and March. Jeremy Morton entered the plea at a hearing before U.S. District Judge Claudia Wilken. Morton will be sentenced by Wilken on Feb. 4 for the six counts of bank robbery. Each count carries a maximum possible sentence of 20 years in prison. U.S. Attorney Melinda Haag said Morton admitted taking a total of $25,911 from the six banks. The amounts lost by each bank ranged from $800 to $9,037. The sites robbed were a Bank of the West branch in Concord on Feb. 16; two Bank of the West outlets in Stockton on Feb. 24 and March 6; a Bank of the West branch in Oakland on March 12; a Citibank in San Leandro on March 24; and a Chase Bank branch in Livermore on March 26. An affidavit filed in the case in April by FBI Special Agent Matthew Ernst said Morton was identified after the FBI circulated bank surveillance photos from the Concord heist among local law enforcement agencies. Two state parole agents recognized Morton as a person who was on parole from a previous bank robbery conviction in Stockton, Ernst said in the affidavit. Morton had a distinctive tattoo with cursive writing on the side of his neck, the agent said. Ernst wrote that in the Concord robbery, a teller reported that a man with a tattoo on his neck approached her and said in a low, deep voice, "I want $5,000." The man also placed a piece of paper on the counter containing the numbers $5,000 and said, "Hurry up." The teller was afraid for her safety and gave the man the $2,054 in her teller drawer. The robber was seen shortly afterwards getting into a car parked along the shoulder of Interstate Highway 680 nearby, according to the affidavit.

Man with strange watch arrested at Oakland airport

OAKLAND, Calif. (AP) — A Southern California man was arrested at Oakland International Airport after security officers found him wearing an unusual watch they said could be used to make a timing device for a bomb, authorities said Friday. Geoffrey McGann, 49, of Rancho Palos Verdes was taken into custody Thursday night after he tried to pass through airport security with an ornate watch that had switches, wires and fuses, according to Sgt. J.D. Nelson, a spokesman for the Alameda County Sheriff's Department. A bomb squad arrived within five minutes and determined there were no explosive materials in the watch, Nelson said. The checkpoint was closed while officers secured the area. McGann was taken to Santa Rita Jail in Dublin where he was charged with possessing materials to make an explosive device, sheriff's officials said. He was still in custody Friday night and could not be reached for comment. McGann told Transportation Security Administration officers that he's an artist and the watch is art, Nelson said. While no actual explosives were found, McGann was carrying potentially dangerous materials and appeared to have made alterations to his boots, which were unusually large and stuffed with layers of insoles, Nelson said. A profile for a person named Geoffrey McGann on the website LinkedIn.com lists him as the owner and creative director of a media production company called Generator Content. He attended the Art College Center of Design in Pasadena from 1984 to 1987, according to the website.

FBI Fires Shots During Raid Of Maryland Home Of Emory Hughley

Shots fired during an early morning FBI raid of a family's suburban Maryland home left an unarmed 18-year-old wounded, the young woman's father said. The family said it was stunned to see a SWAT team of a 15 agents burst into their Prince George's County home at 6 a.m., according to WJLA. FBI officials later said they were there Thursday to perform a search warrant, but didn't divulge the reason for the visit. However, MyFoxDC reported that this was part of a coordinated series of FBI actions at locations in Washington, D.C. and Maryland. The station maintains that four people were arrested in the other raids on charges connected to heroin dealing. Emory Hughley, the father, tried to assure the agents that no one in the home had a gun. When officers saw his daughter Myasia standing outside her bedroom, an officer yelled, "She's got a gun," which started a volley of gunfire, Hughley said. It's unclear what led them to believe she had a weapon. The teen wasn't directly hit, but her father said that "shrap metal" scraped Myasia's neck. She was taken to a hospital for the flesh wound and released. It's believed that one agent fired multiple times at the teen in the living room, MSNBC said. There are several bullet holes in the house, according to reports. But there are differing accounts of what happened. A Baltimore field agent for the FBI told the Washington Post that the teen's injury was caused by a fall, not gunfire. Neighbors reported hearing a bang at 6:30 a.m and several outlets reported that there weren't any known problems with the family.

50 Cent was officially approved for a boxing promoters license by the Nevada State Athletic Commission this week, just two weeks after severing ties with Floyd Mayweather. According to ESPN.com, Fif decided to launch his own SMS Promotions after a falling out with Floyd Mayweather, because the undefeated boxing great failed to come up with his share of the seed money 50 said he promised to put up. So, after their public split, the hip-hop mogul applied for the license under SMS Promotions, and his application was approved in a 5-0 vote of the commission on Thursday (November 15). During the questioning process, 50 said he and Mayweather had previously agreed to go into the boxing promotions business together, but, when the boxer "came out of incarceration (on Aug. 3 after two months in county jail in Las Vegas) he decided he wanted to do things differently, but I had already invested $1.5 million in acquiring fighters and I would like to move forward." Despite the betrayal, 50 said he and Mayweather had no written agreement between each other. In all, the rapper said he spent $500,000 toward the company in addition to the money he spent in acquiring fighters. His roster includes former featherweight titlist Yuriorkis Gamboa, featherweight titlist Billy Dib, and super middleweight contender Andre Dirrell. In addition to Vegas, 50 Cent was previously licensed in New York. After being licensed, SMS was approved to co-promote Gamboa's bout with Top Rank on the Pacquiao-Marquez IV undercard. However, Gamboa will face an opponent to be determined because Miguel Beltran Jr. has dropped out.

Hero Vets Die Saving Wives in Texas Parade Crash

Police have identified the four servicemen who died in Midland, Texas when a freight train plowed into a parade float carrying wounded veterans and their spouses at a crossing, two of whom saved their wives by pushing them to safety before they died. Army Sgt. Maj. Gary Stouffer, 37, and 47-year-old Army SGM Lawrence Boivin were pronounced dead at the scene, police said, after the float carrying wounded veterans and their families to an honorary banquet was struck by a Union Pacific train around 4:30 p.m. Thursday afternoon. The train struck as the parade was crossing the tracks, turning the honorary event into a scene of destruction. Army Sgt. Joshua Michael, 34, and 43-year-old Army Sgt. Maj. William Lubbers were transported from the scene and later pronounced dead at Midland Memorial Hospital, according to the Midland Police. Seventeen people in all were transported to the hospital and 10 were treated and released. Four people were in stable condition and one is in critical condition as of this morning.

Man accused of $11 million fake Jasper Johns sculpture scam

A New York foundry owner has been arrested on a charge he tried to sell a fake Jasper Johns sculpture for $11 million. The U.S. attorney's office says in 1990 the well-known American artist provided Brian Ramnarine with a mold for a famous 1960 sculpture called "Flag" to make a wax cast. Prosecutors say Ramnarine made the cast but never returned the mold. Court documents say 20 years later Ramnarine tried to sell a bronze flag made from the original mold without the artist's knowledge and using the artist's forged signature. Ramnarine was arrested at his Queens home on Thursday. He has been indicted on a charge of wire fraud and would face up to 20 years in prison if convicted. Attempts to contact Ramnarine were unsuccessful.

Elmo puppeteer accused of underage relationship

NEW YORK (AP) — The puppeteer who performs as Elmo on "Sesame Street" is taking a leave of absence from the iconic kids' show in the wake of allegations that he had a relationship with a 16-year-old boy. Puppeteer Kevin Clash has denied the charges, which, according to Sesame Workshop, were first made in June by the accuser, who by then was 23. "We took the allegation very seriously and took immediate action," Sesame Workshop said in a statement issued Monday. "We met with the accuser twice and had repeated communications with him. We met with Kevin, who denied the accusation." The organization described the relationship as "unrelated to the workplace." Its investigation found the allegation of underage conduct to be unsubstantiated. But it said Clash exercised "poor judgment" and was disciplined for violating company policy regarding Internet usage. It offered no details. "I had a relationship with the accuser," Clash said in a statement of his own. "It was between two consenting adults and I am deeply saddened that he is trying to characterize it as something other than what it was." Sex with a person under 17 is a felony in New York if the perpetrator is at least 21. It was unclear where the relationship took place, and there is no record of any criminal charge against Clash in the state. Clash, the 52-year-old divorced father of a grown daughter, added, "I am a gay man. I have never been ashamed of this or tried to hide it, but felt it was a personal and private matter. "I am taking a break from Sesame Workshop to deal with this false and defamatory allegation," he said. Neither Clash nor Sesame Workshop indicated how long his absence might be. "Elmo is bigger than any one person and will continue to be an integral part of 'Sesame Street' to engage, educate and inspire children around the world, as it has for 40 years," Sesame Workshop said in its statement. "Sesame Street" is in production, but other puppeteers are prepared to fill in for Clash during his absence, according to a person close to the show who spoke on condition of anonymity because that person was not authorized to publicly discuss details about the show's production. "Elmo will still be a part of the shows being produced," that person said. Though usually behind the scenes as Elmo's voice and animator, Clash has become a star in his own right. In 2006, he published an autobiography, "My Life as a Furry Red Monster," and was the subject of the 2011 documentary "Being Elmo: A Puppeteer's Journey." In addition to his marquee role as Elmo, Clash also serves as the show's senior Muppet coordinator and Muppet captain. He has won 23 daytime Emmy awards and one prime-time Emmy. Clash has been a puppeteer for "Sesame Street" since 1984, when he was handed the fuzzy red puppet with ping-pong-ball eyes and asked to come up with a voice for him. Clash transformed the character, which had languished as a marginal member of the Muppets family for a number of years, into a major star that rivaled Big Bird as the face of "Sesame Street." Is the 2013 Range Rover the world’s best SUV? Motoramic TV

The 2012 Range Rover was swell — beautiful interior, powerful engines and styling that earned icon status about five years ago. Designed and introduced back when BMW owned Rover, the Range Rover was the rare design that survived a full decade without seeming dated. But ten years equals an eternity in the car business, and 2013 heralds a new Range Rover era. The new SUV looks much like the old one, embracing the Porsche 911 strategy of not messing with a good thing, but making it just different enough to tip off the neighbors. The real action lies under the skin, where Land Rover tackled the old machine's biggest problem: its weight. Thanks to an all-aluminum chassis (the only one in an SUV), the new Range Rover is about 700 pounds lighter than the old one. The bare body is in fact 50 pounds lighter than that of a BMW 3-series, and the base V-8 model weighs 4,850 lbs. Subtracting weight, rather than adding power, confers all sorts of advantages — handling, fuel economy and off-the-line quickness all improve. I recall that when Porsche introduced the original Cayenne Turbo, they said something to the effect of, "This thing is 90 percent of a Range Rover off road and 150 percent better on-road." Since then, the Porsche has dialed back its off-road aspirations, but the Range Rover has drastically improved its on-pavement prowess. Burdened with so much less weight and bolted to the new ZF 8-speed transmission, the carryover direct-injected V-8s (in 375 hp naturally aspirated and 510 hp supercharged flavors) hurtle this box down the road with nearly Porsche-like haste. The Supercharged model does 0-60 mph in 5.1 seconds, splitting the difference between a Cayenne S and a Cayenne Turbo. That's pretty nifty for a machine that is still equipped to crawl up mountains in Africa.

Dont ask me how im getting fashion out of these movies, its more along the lines of there heritage and honor. And the colors are vivid so that is helping with that aspect of it. U.S. Court Orders Apple To Pay $368 Million Damages For FaceTime Patent Infringement

Apple can’t catch a break in the courts right now. In the latest legal blow for Cupertino, a U.S. court has ruled its FaceTime videocalling technology infringes four patents owned by technology company VirnetX. A U.S. Court for the Eastern District of Texas has ordered Apple to pay more than $368 million in damages to VirnetX. The patents in question are U.S. Patent Nos. 6,502,135, 7,418,504, 7,921,211 and 7,490,151 — which include a way of establishing a secure comms link. Apple has the option to appeal the decision. We’ve reached out to Apple and VirnetX for further comment and will update with any response. Commenting on the win, Kendall Larsen, VirnetX CEO and President, said in a statement: “We are extremely pleased with the outcome of our suit with Apple. This victory further establishes the importance of our patent portfolio.” The BBC reports that the damages award is around half the amount VirnetX had originally sought. It also notes that VirnetX has previously secured a $200m settlement from Microsoft over similar claims. The company, which has a patent portfolio of 20 U.S. and 26 international patents, has also brought cases against Cisco, Avaya and Siemens for allegedly infringing the same patents. Apple’s recent legal woes include a U.S. judge dismissing a patent licensing case against Motorola Mobility, a U.K. court sticking by a ruling that Samsung’s Galaxy Tab tablets do not infringe the design of the iPad, and a Dutch court ruling that Samsung does not infringe an Apple multitouch patent. Milwaukee Cops on Trial for illegal body cavity searches

MILWAUKEE (AP) — Prosecutors can proceed with a case against four Milwaukee police officers charged with conducting illegal strip searches of suspects, a judge ruled Friday. Milwaukee County Circuit Judge Jeffrey Wagner heard about three hours of testimony from Milwaukee police detective Justin Carloni, who recapped testimony that nine alleged victims gave at secret proceedings that led to the charges last month. The judge decided that prosecutors had sufficient probable cause to move forward with their case. According to the criminal complaint, several men alleged that Officer Michael Vagnini stopped them and performed a cavity search, saying he was looking for drugs. Vagnini is charged with 25 counts, including conducting an illegal strip search, misconduct in office, sexual assault and conducting an illegal body cavity search. State law and police procedures prohibit officers from conducting body cavity searches. Only medical personnel are allowed to perform them, and police must first obtain a search warrant. Attorneys for the other officers argued Friday that the charges should be dismissed because what their clients are accused of doing — sometimes just being present at searches — doesn’t rise to the threshold of party-to-a-crime liability. District Attorney John Chisholm argued that the officers’ mere presence, on duty, reasserted to the suspects that they were not free to leave and had to comply with the searches.

Why It May Be Illegal to Instagram Your Ballot

Proud voters are already posting photos of their ballots on Instagram—sometimes with the names of their chosen candidates filled in. But before you snap a shot of your vote, you might want to check your state laws. As the Citizen Media Law Project points out as part of their guide to documenting the 2012 election, showing your marked ballot to other people is actually illegal in many states. Laws against displaying your ballot are motivated by concerns about vote buying, since voters being bribed might need to be prove they voted a certain way. While laws vary from state to state, the penalties for showing your ballot can be stiff. “It’s illegal to display your voted ballot and violators could be convicted of a misdemeanor,” Colorado secretary of state spokesman Richard Coolidge told ProPublica. The penalty, according to Colorado law: a fine of not more than $1000, imprisonment in county jail for not more than one year — or both. In Michigan and Hawaii, voters who show their ballots to other people can, in certain circumstances, have their votes thrown out. It’s not clear how these rules apply to sharing a picture of your ballot on the Internet, or whether states would actually prosecute voters for an Instagram shot. Officials from Hawaii have yet to respond to a request for comment. In Michigan, voters will have their ballots confiscated if they are found taking a photo or video of a ballot in a polling place, said Fred Woodhams, a spokesman for the Michigan department of state. Once an exposed ballot is confiscated, voters do not get a new one. That doesn’t mean the state is monitoring the web for violations. “Certainly, we’re not going to Instagram to find people’s ballots,” he said. “Virtually all of these laws are older laws that predate the current technology,” said Jeffrey Hermes, a First Amendment expert who wrote the Citizen Media Law Project’s guide to ballot disclosure rules. But, he warned in his guide, “It is easy to imagine situations in which the thoughtless posting of a marked ballot on Facebook could result in negative consequences.” Rick Hasen, an election law expert at the University of California, Irvine, said that taking a picture of your marked ballot is “bad news.” “Hard as it is to believe, before the secret ballot there was a lot more vote buying and we don't want more of that now,” he wrote in an email. A North Carolina elections official told WRAL last week that a “criminal vote-buying scheme” in another state had involved cell phone pictures of completed ballots. Some states simply prohibit using phones or cameras within a polling place. Allowing voters to publicly display their ballots might also undermine the culture of the secret ballot, Hermes said. Another factor is the fear that voters might be intimated or swayed by seeing other people’s ballots. “These are legitimate concerns,” Hermes said, “but they only extend so far.” If voters “want to express what they feel and their experience and the polls, the First Amendment should protect that,” he said. Josh Stearns of Free Press, a media and technology advocacy group, told ProPublica he did not see much difference between wearing a t-shirt supporting a candidate, and sharing a photograph of your ballot. “For a lot of people, voting is a really important life event,” he said. “We can take our kids into the voting booth, but in many places we can’t take a picture of our ballot.” Stearns said that allowing individuals to photograph their ballots might also be an important way of providing them with a record of their own vote. Students interviewed this week by the DePaul University student paper had a range of views on posting ballot photos on Instagram, from approval to disappointment that voting had become “just another thing you can tweet.” At least one state has recently changed its stance on the issue, Hermes said. Maine repealed its ban on voters showing their own ballots in 2011.

World's Rarest Whale Seen for First Time

The world's rarest whale has been spotted for the first time, in New Zealand, where two of the whales stranded themselves. The two spade-toothed beaked whales, a mother and calf, stranded and died on Opape Beach on the North Island of New Zealand, in December 2010. The mother was 17 feet (5.3 meters) long and the calf was 11 feet (3.5 m) long. A report describing the whales and the analysis of their DNA appears in the Nov. 6 issue of the journal Current Biology. "Up until now, all we have known about the spade-toothed beaked whale was from three partial skulls collected from New Zealand and Chile over a 140-year period. It is remarkable that we know almost nothing about such a large mammal," Rochelle Constantine, a marine biologist at the University of Auckland in New Zealand, said in a statement. "This is the first time this species has ever been seen as a complete specimen, and we were lucky enough to find two of them." At first, the animals were thought to be much more common Gray's beaked whales. Their identity came to light following routine DNA analysis, which was done as part of a 20-year program to collect data on beaked whale species in New Zealand waters. New Zealand is a known hotspot for whale stranding, and it has the highest rates and greatest diversities of stranded whale species in the world, the researchers report. The New Zealand Department of Conservation photographed the animals and collected tissue samples. "When these specimens came to our lab, we extracted the DNA as we usually do for samples like these, and we were very surprised to find that they were spade-toothed beaked whales," Constantine said. "We ran the samples a few times to make sure before we told everyone." The researchers said they have no idea why the whales have remained so elusive. "It may be that they are simply an offshore species that lives and dies in the deep ocean waters and only rarely wash[es] ashore," Constantine said.

Six States To Decide Tomorrow On Marijuana Measures

Millions of voters will decide on Election Day in favor of ballot measures to legalize and regulate the use of cannabis by adults. Voters in three states — Colorado, Oregon, and Washington — will decide on statewide ballot measures to legalize the possession and distribution of cannabis for those over 21 years of age. Voters in three additional states — Arkansas, Massachusetts, and Montana — will decide on measures to allow for the therapeutic use of cannabis by patients with qualifying ailments. In Michigan, voters in four cities – totaling over a million people – will decide on municipal measures to legalize or depenalize the adult use of cannabis. Ballot measures in Colorado, Massachusetts, and Washington remain favored among voters, according to the latest statewide polls. Since 1996, 17 states have enacted legislation to allow for the limited possession of cannabis when a physician authorizes such use. In ten of those states, voters enacted medical cannabis legislation via the statewide initiative process. But to date, no statewide proposal to remove criminal and civil penalties for the broader, personal possession and use of marijuana by adults has succeeded at the ballot box. This reality is likely to change tomorrow. A summary of this year’s more prominent statewide and local ballot measures appears below. ARKANSAS: Voters will decide on Measure 5, The Arkansas Medical Marijuana Act of 2012, which allows authorized patients to possess up to two and one-half ounces of cannabis for various qualifying medical conditions, including cancer, Crohn’s disease, fibromyalgia, and post-traumatic stress disorder (PTSD). The measure also allows state regulators to establish not-for-profit facilities to produce and dispense cannabis to approved patients. Individual patients will also be permitted to privately cultivate limited amounts of cannabis (up to six flowering plants) if they reside further than five miles from a state-authorized dispensary. COLORADO: Voters will decide on Amendment 64, which allows for the legal possession of up to one ounce of marijuana and/or the cultivation of up to six cannabis plants by those persons age 21 and over. Longer-term, the measure seeks to establish regulations governing the commercial production and distribution of marijuana by licensed retailers. Voters in the state approve of the measure by a margin of 50 percent to 44 percent, according to the latest Denver Post survey. MASSACHUSETTS: Voters will decide on Question 3, which eliminates statewide criminal and civil penalties related to the possession and use of up to a 60-day supply of cannabis by qualified patients. It would also require the state to create and regulate up to 35 facilities to produce and dispense cannabis to approved patients. Individual patients will also be permitted to privately cultivate limited amounts of cannabis if they are unable to access a state-authorized dispensary. Voters in the state approve the measure by a margin of 55 percent to 36 percent, according to the latest Suffolk University poll. MICHIGAN: Voters in four cities – totaling over a million people – will also decide on Tuesday whether to legalize or depenalize the adult use of cannabis. Voters in Detroit will decide on Proposal M, which removes criminal penalties pertaining to the possession on private property of up to one ounce of marijuana by adults over age 21. In Flint, voters will decide on a citizens’ initiative to amend the city code so that the possession on private property of up to one ounce of marijuana or cannabis paraphernalia by those age 19 or older is no longer a criminal offense. Grand Rapids voters will act on Proposal 2, which seeks to allow local law enforcement the discretion to ticket first-time marijuana offenders with a civil citation, punishable by a $25 fine and no criminal record. In Ypsilanti, voters will decide on a proposal to make the local enforcement of marijuana possession offenses the city’s lowest law enforcement priority. MONTANA: Voters will decide on Initiative Referendum 124. A ‘no’ vote on IR-124 would repeal newly enacted restrictions to the state’s 2004 voter-approved medical marijuana law. OREGON: Voters will decide on Measure 80, the Oregon Cannabis Tax Act, which provides for the state-licensed production and retail sale of cannabis to adults. The measure does not impose state-licensing or taxation requirements upon those who wish to cultivate cannabis for non-commercial purposes. WASHINGTON: Voters will decide on I-502, which regulates the production and sale of limited amounts of marijuana for adults. The measure also removes criminal penalties specific to the adult possession of up to one ounce of cannabis for personal use. Voters in the state back the measure by a margin of 56 percent to 37 percent, according to the latest KING 5 poll.

The iPad we know and love seemed to vanish yesterday. Call it the featherweight KO'ing the heavyweight. On the first day of sales, the 312-gram Mini knocked the 652-gram fourth-generation iPad into quick obscurity. I knew there was a problem when I had to explain to people asking me about the iPad Mini that there was also this thing called the gen 4 (gen 3.5 may actually be more accurate) iPad. And some stores weren't exactly aware of the new iPad either. A sales rep at a certain large U.S. retail store (which will go unnamed) in Los Angeles gushed about the iPad Mini but was stumped when I asked about the gen 4 iPad. "You know, the one right in front of you," was (more or less) what I had to say. Though I like the Mini, I'm partial to the fourth-generation iPad for, among other things, reasons I reported on yesterday. It's the first iPad to get Apple's A6 chip -- in this case a turbocharged version called the A6X -- and every step the iPad takes toward laptop-class processing power has got my attention. But I'm in the minority. The problem, of course, is that it looks the same as the gen 3 iPad, except for the Lightning connector. There are other minor improvements too. The front-facing FaceTime camera has been upgraded to HD 720p video. The 4G/LTE iPad also works with a wider range of international carriers. None of that appears to be enough to get people's attention, though. And it's not going to get easier for Apple. With the Nexus 10 tablet, Microsoft Surface, and the crush of tablets and hybrids coming from the Windows 8 crowd, Apple is going to need to make a bold statement with the next 10-inch class iPad. Until then, we have the incredible invisible iPad.

Child killed in African wild dogs pen at Pittsburgh zoo

The child, said to have been aged about three, had been on an outing with his mother when he fell over a railing and off a mesh barrier into the exhibit. Zoo keepers called off most of the 11 dogs, but one refused to move away from the boy and was shot dead. The zoo was closed after the incident, and an investigation by the police and the zoo is under way. "It is with great sadness and very, very heavy hearts that we report today that a small child was killed by our African painted dog pack this morning," head of the zoo, Barbara Baker, told a news conference. She said it was clear the dogs had attacked the boy, but that "whether he died of the attack or the fall has yet to be determined". No decision had been made about the future of the enclosure, she said. African painted dogs, also known as African wild dogs, are an endangered species. They are the size of medium domestic dogs and hunt in packs.
