KAUFMAN, Texas (AP) — Authorities say an assistant district attorney has been shot and killed near the North Texas county courthouse where he worked. The shooting occurred just before 9 a.m. Thursday outside a building across from the main Kaufman County courthouse. Authorities say they are seeking two suspects in the shooting. No motive has been released. The name of the prosecutor was not immediately announced, pending notification of family. The courthouse was initially locked down, but that has since been lifted. At a news conference, local law enforcement officials decried the shooting as an attack on the criminal justice system.

The jaws of life were used to pull people out of three cars. The highway has since been closed. This story is developing. The accident started shortly before 9 a.m. over the Rouge River Bridge, said Robert Morosi of the Michigan Department of Transportation. At least 30 cars were involved in the pileup, he said. Snow was falling at the time of the crash, Morosi said, describing conditions as a "typical Michigan winter morning."

Hostess set to announce bidders for Twinkies

NEW YORK -- The indestructible Twinkie appears to be one step closer to a comeback. Hostess Brands is close to announcing that it has picked two investment firms - C. Dean Metropoulos & Co. and Apollo Global Management - as the lead bidders for its Twinkies and other snack cakes, according to a source close to the situation. The joint "stalking horse" bid would set the floor for an auction process that lets competitors make better offers. A judge would have to approve any final sale. After years of management turmoil and turnover, Hostess declared it was going out of business and selling its brands in November. Hostess has already picked separate lead bidders its Drake's cakes and breads, which include Wonder.

Man who oversaw Nigeria police pensions pleads guilty to stealing $145M

ABUJA, Nigeria (AP) -- A man who formerly helped oversee Nigeria's police pension program pleaded guilty Monday to stealing $145 million, but walked out of court a free man after agreeing to a plea bargain that saw him pay only a fraction of it back. The plea deal given to John Yakubu Yusufu and read out in court sparked immediate anger across Nigeria, a nation where many feel government officials pilfer pension funds and oil revenue without any fear of prosecution. Yusufu will pay only a $14,000 fine, forfeit some properties and pay about $2 million in restitution, something that the nation's top anti-corruption agency immediately criticized. Justice Mohammed Talba, who agreed to the plea deal in a Federal High Court, sentenced Yusufu to serve two years in prison. However, Talba said Yusufu could pay the fine and the restitution, which also includes turning over 32 properties he allegedly purchased with the stolen money. In asking for the plea deal, Yusufu's defense lawyer, Theodore Bala Maiyakim, said his client had a serious heart condition. "He has saved the time of my Lord and being a first offender, with no previous record of conviction, I urge the court to temper justice with mercy and sentence him with least possible terms," Maiyakim asked, according to an account provided by Nigeria's Economic and Financial Crimes Commission. Prosecutor Rotimi Jacobs, however, called for Yusufu to serve prison time to "send out the message that the era of stealing public funds with impunity is gone." Under the three charges filed against Yusuf, he could have served a maximum of six years in prison. Six others allegedly involved in the scam have pleaded not guilty.

Cats kill billions of wildlife yearly

Cats kill billions of birds every year and even more tiny rodents and other mammals in the United States, a new study finds. According to the research, published today (Jan. 29) in the journal Nature Communications, cats kill between 1.4 billion and 3.7 billion birds and between 6.9 billion and 20.7 billion small mammals, such as meadow voles and chipmunks. Though it's hard to know exactly how many birds live in the United States, the staggering number of bird deaths may account for as much as 15 percent of the total bird population, said study co-author Pete Marra, an animal ecologist with the Smithsonian Conservation Biology Institute. Staggering toll Marra and his colleagues are looking at human-related causes for bird and wildlife deaths in the country, from windmills and glass windows to pesticides. But first, Marra and his team looked at the impact of the feline population, one of the biggest putative causes of bird demise in the country. While past studies had used critter cams or owner reports to estimate the number of birds killed by cats, those studies were usually small and not applicable to the entire country, Marra told LiveScience. For this broader analysis, the team first looked at all prior studies on bird deaths and estimated that around 84 million owned-cats live in the country, many of which are allowed outdoors. "A lot of these cats may go outside and go to 10 different houses, but they go back to their house and cuddle up on Mr. Smith's lap at night," Marra said. Based on an analysis of past studies, the researchers estimated that each of those felines killed between four and 18 birds a year, and between eight and 21 small mammals per year. But the major scourges for wildlife were not those free-ranging, owned-cats, but instead feral and un-owned cats that survive on the streets. Each of those kitties — and the team estimates between 30 million and 80 million of them live in the United States — kills between 23 and 46 birds a year, and between 129 and 338 small mammals, Marra said. And, it seems, the small rodents taken by felines aren't Norway rats or apartment vermin, but native rodent species such as meadow voles and chipmunks, he added.

Man wrongly charged in Texas shooting released from jail

SAN ANTONIO (Reuters) - A man who police said was wrongly charged in connection with a shooting at a Texas community college last week, was released from jail on Monday after charges against him were dismissed. Carlton Berry, 22, who was being treated in a jail hospital ward for injuries he received in the shooting, was released from jail on Monday afternoon, said Sara Kinney, a spokeswoman for the Harris County District Attorney's Office. "All the charges against him were dismissed," Kinney said. "He is free to go." No one was killed in the shooting on a campus of Lone Star College near Houston. But the incident raised national concern coming just over a month after the massacre of children at a Newtown, Connecticut, elementary school. Berry was the first person charged after the January 22 shooting. He was charged with aggravated assault based on an erroneous identification of him as the shooter by a witness. Police later charged a second person, Trey Foster, 22, in the case. Foster made his first court appearance on Monday. Jail records show he remains behind bars on two felony charges of aggravated assault with a deadly weapon and one count of misdemeanor resisting arrest. The confrontation started after a third person, Jody Neal, bumped into Foster on the campus, police said. An argument erupted and officials say Foster fired 10 shots. Neal, Berry, who had gone to the library with Foster, and a college maintenance man were wounded. Investigators originally thought Foster accidentally shot himself but have revised that to indicate that they now believe Foster shot all three men. Foster was arrested on Friday in the Dallas suburb of Plano, and a gun, believed to be the weapon used in the shooting, was recovered, officials said. Russell Simmons thoughts on Rick Ross shooting

This Rick Ross shooting this morning got me thinking. I don't know his situation, but I definitely can relate. I was walking in those shoes at one point in my life. First and foremost, I am thankful that no one got hurt. So I gotta pray that Rick has a faster and smoother transition from the streets to the music. I grew up in Hollis, Queens and for a while I was a small time drug dealer. Nevertheless, no matter how small, I was "in the life." I was playing with fire, but I didn't know it. As a petty drug dealer, there wasn't one big-time drug dealer who even knew I existed. I was lucky enough to find the passion for music and smart enough to stop selling drugs. The minute I got hot in the record business, all of the big drug dealers became my best friends. All of them showed up at every Def Jam party, offering me "protection" and "support" that I didn't need. These n*ggas would scare everyone in the party and I guess at the time, that was kind of "cool." To the people in the party, they were known as "Russell's friends." I hate to say this as a yogi, but all of my "friends" died or went to jail and lucky for me, I didn't go with them. I had a job that I loved and believed in and a future. Over the years, I've had to show up to court cases as a character witness for more than a few artists and owners of record companies who themselves were not guilty of any crime, but glamorizing and hanging out with knuckleheads. I'm sure Rick Ross doesn't need this kind of drama in his life. Rick and artists like him, maybe need to make some tough decisions. My advice is they need to stay the f*ck away from guys who are only showing up for the ride...period.

JC Penney brings back the big discounts it ditched last year

NEW YORK (AP) -- J.C. Penney is bringing back sales. The struggling department store chain this week will begin adding back some of the hundreds of sales it ditched last year in hopes of luring shoppers who were turned off when the discounts disappeared, CEO Ron Johnson told The Associated Press. Penney also plans to add price tags or signs for more than half of its merchandise to show customers how much they're saving by shopping at the chain — a strategy used by a few other retailers. For store-branded items such as Arizona, Penney will show comparison prices from competitors. The reversal comes on the eve of the one-year anniversary of its original vow to almost completely get rid of the sales that Americans covet but that cut into a store's profits. The idea was to offer everyday low prices that customers could count on rather than the nearly 600 fleeting discounts, coupons and sales it once offered. The bold plan has been closely watched by others in the retail industry, which commonly offers deep discounts to draw shoppers. But so far the experiment has served as a cautionary tale of how difficult it is to change shoppers' habits: Penney next month is expected to report its fourth consecutive quarter of big sales drops and net losses. After losing more than half of its value, Penney's stock is trading at about $19. And the company's credit ratings are in junk status.

A new market, black as ink, in NYC: printer toner

The con game at Memorial Sloan-Kettering dates to 2007, when one of Gumbs' duties as a receiving clerk paid $37,800 a year was to order supplies from an Office Depot website. Prosecutors accused him of ordering $1.5 million in cartridges - priced at $200 a piece - that didn't fit any of the copiers and printers at the hospital. Gumbs also short-circuited hospital procedures by having delivery drivers call his cellphone and meet him at the curb outside. He then stashed the toner in a garbage area so he could retrieve it later. By the time he was done, Gumbs had used his fraudulent profits to rent a luxury apartment in suburban Westchester County, make a $50,500 down payment on a BMW, and pay for shopping sprees at Burberry, Fendi and Gucci stores. Bank and credit card records showed deposits of $150,000, and purchases of airline tickets and hotel rooms in Las Vegas; Cancun, Mexico; and Orlando, Fla. Gumbs, 34, pleaded guilty last year and was sentenced to 2 1/2 to 7 1/2 years behind bars. He also was ordered to forfeit his BMW, Rolex, laptop computers, four Louis Vuitton bags and other items bought with ill-gotten gains.

7 people killed in shootings during bloody Chicago day

CHICAGO – Chicago authorities say seven people were killed and six wounded in gun violence in one day. Among those killed Saturday was a 34-year-old man whose mother had already lost her three other children to shootings. Police say Ronnie Chambers, who was his mother's youngest child, was shot in the head while sitting in a car. "Right now, I'm totally lost because Ronnie was my only surviving son," said his mother, Shirley Chambers. Shirley Chambers' first child, Carlos, was shot and killed by a high school classmate in 1995 after an argument. He was 18. Her daughter Latoya, then 15, and her other son Jerome were shot and killed within months of one another in 2000. Police say two separate double-homicide shootings also occurred Saturday about 12 hours apart. In one, a 16-year-old boy and a 32-year-old man were killed. In another, two men were shot at a hamburger stand on the city's South Side. Police say the victims were roommates in their 40s. Chicago's homicide count eclipsed 500 last year for the first time since 2008. Chicago's homicide rate was almost double in the early 1990s, averaging around 900. Last year's increase, though, stood in sharp contrast to New York, where homicides fell 21 percent from 2011, as of early December. 40 years ago Lions receiver Chuck Hughes died on Tiger Stadium gridiron

t remains the greatest tragedy to have ever occurred during an NFL game. Forty years ago today on October 24, 1971, at Tiger Stadium Detroit Lion wide receiver Chuck Hughes died on the field of a fatal heart attack with just over a minute to play in a game that would be won by the Bears 28-23. The score was meaningless. Life suddenly seemed more precious, especially to the stunned crowd of 54,418 fans, the players, and a press corps that would struggle to find the right words to describe what had happened. The 28-year old Texan had just run a pass route on a play that turned into an incomplete pass intended for Lion tight end Charlie Sanders. As he jogged back to the huddle Hughes suddenly fell face first on the Bears’ 15 yard line. Everyone knew something was wrong when the Bears’ vicious middle linebacker Dick Butkus started frantically waving his hands to the Detroit sideline signaling for help. Trainer Kent Falb and team physicians Edward Guise and Richard Thompson ran onto the field and were soon joined by a Lion fan that jumped out of the stands, Dr. Eugene Boyle, an anesthesiologist from Grosse Pointe. It was reported that Hughes had already turned as blue as his number 85 jersey. A stadium had never been silenced so quickly. Witnesses said you could hear a pin drop and at least one has said he is still haunted by the sound of the ambulance siren as it pulled away from the eerily quiet ballpark. Numerous attempts to resuscitate the father of a 23-month old son were made for up to an hour on the field, in the ambulance and at Henry Ford Hospital. Hughes was officially pronounced dead at 5:41 PM but reports circulated that he had actually died when he hit the turf. An autopsy revealed that Hughes had arteriosclerosis, an abnormal thickening of the artery walls. Just a few weeks earlier at an exhibition game he had complained of chest pains but was cleared to play. (His widow subsequently filed a $21.5 million malpractice lawsuit against Henry Ford Hospital for failing to diagnose the problem six weeks earlier. The case settled in 1974 for an undisclosed amount.) Following the funeral attended by the entire team in San Antonio Texas, the Lions wore a black arm band on their left sleeve for the remainder of the season. At the next game, an ABC Monday Night contest at Green Bay’s Lambeau Field, a moment of silence was held in his memory. In his honor the Lions retired Hughes’ number 85 and annually they give an award to the most improved player in his name. Someday, I am hopeful that the Lions will finally hang their championship banners at Ford Field along with jersey banners for their Hall of Fame players. And next to those jerseys should be number 85.

Next Made-in-China Boom: College Graduates

SANYA, China — Zhang Xiaoping’s mother dropped out of school after sixth grade. Her father, one of 10 children, never attended. But Ms. Zhang, 20, is part of a new generation of Chinese taking advantage of a national effort to produce college graduates in numbers the world has never seen before. A pony-tailed junior at a new university here in southern China, Ms. Zhang has a major in English. But her unofficial minor is American pop culture, which she absorbs by watching episodes of television shows like “The Vampire Diaries” and “America’s Next Top Model” on the Internet. It is all part of her highly specific ambition: to work some day for a Chinese automaker and provide the cultural insights and English fluency the company needs to supply the next generation of fuel-efficient taxis that New York City plans to choose in 2021. “It is my dream,” she said, “and I will devote myself wholeheartedly to it.”

There’s A Billboard In New England With A Countdown To Ray Lewis’ Retirement Party

Up in Massachusetts a video billboard is displaying a live countdown to Ray Lewis’ retirement party on Sunday. The billboard is on Route 93 north on the Medford/Stonehome line and on Route 495 in Lawrence according to Steve Silva of Boston.com. I don’t know where that is, but the picture makes it look like it’s a pretty busy street. Honestly, I love stuff like this. I hope the Ravens print it out on a giant poster and hang it in their locker room. Broncos fans were overly confident too. How’d that work out for them?

Navy Ship Runs Aground in Philippines

A U.S. Navy minesweeper has run aground on a reef in the Sulu Sea in the Philippines. The ship remains stuck on the reef. No injuries were reported among the ship's crew of 81 and there were no indications of a fuel leak. A Navy statement said the USS Guardian (MCM-5) ran aground on the Tubataha Reef at 2:25 a.m. local time while transiting in the Sulu Sea. The reef is located almost 400 miles south of the Philippine capital of Manila. According to the statement released by the Navy's Seventh Fleet, the Avenger-Class mine countermeasures ship was en route to its next port of call when the grounding occurred in the middle of the Sulu Sea. "The ship is currently stuck on the reef, approximately 80 miles east-southeast of Palawan Island," said the statement late Wednesday. "The crew is currently working to determine the best method of safely extracting the ship." A Navy official said the grounding is under investigation. An initial damage assessment did not find any leakage of fuel or oil from the ship. The ship's crew of 81 included six officers and 75 enlisted sailors. The USS Guardian is based in Sasebo, Japan.

White House: Texas must remain part of the US

EL PASO, Texas (AP) — Bad news for thousands of people who wanted to see Texas secede: The state is still in the U.S. The White House has responded to a petition asking that Texas be allowed to break away from the country, saying the Founding Fathers who created the nation "did not provide a right to walk away from it." More than 125,000 people signed the petition, which was created a few days after President Barack Obama won re-election. The White House has promised to respond to any petition that gets more than 25,000 signatures within 30 days. Jon Carson, director of the White House Office of Public Engagement, issued a response quoting Abraham Lincoln's first inaugural address and a Supreme Court opinion after the Civil War. It said America was created as a "perpetual union," but one that allows people with different beliefs to debate the issues.

Couple sharing same name have split

The couple who met, fell in love and married over a shared name, have now filed for divorce. Kelly Hildebrandt and Kelly Hildebrandt have gone their separate ways. The pair with matching names made news when they tied the knot in 2009. But the couple came to realize that sharing a name wasn't enough to keep them together. “She’s a Florida girl, and I’m a Texas guy,” Kelly Carl told Miami news station NBC 6. “We really did come from pretty different worlds.” The romance started in the same world: Facebook. One night in 2008, Kelly Katrina was curious and bored. Wondering if anyone on the website shared her name, she typed it into the search engine on the social networking site and up popped Kelly Carl. The then-20-year-old emailed the 24-year-old about the coincidence. Emails led to phone calls, phone calls to visits, and the whirlwind romance led to an engagement ring hidden in a treasure box on a Florida beach. The two wed in 2009, and their news made People magazine and the "Today" show. But even sharing a name, blond good looks and worldwide attention was not enough to save the marriage. “How do they term it at the courthouse? ‘Irreconcilable differences,' that is what I would say,” added Kelly Carl, who has since returned to his native Texas. “We gave it our best shot.”

Robbers assault 2 hostages at Los Angeles store

LOS ANGELES (AP) — Employees were closing up at a mall department store and preparing to go home when two gunmen stormed inside and took them hostage. The thugs stabbed one of the 14 Nordstrom Rack employees and sexually assaulted another before SWAT officers freed everyone early Friday, more than three hours after the ordeal began. Nordstrom spokeswoman Tara Darrow said the gunmen did commit a robbery before fleeing the store near Los Angeles International Airport. Both remained at large. She declined to describe what was stolen. The harrowing incident began about 11 p.m. Thursday, when a man reported his girlfriend had called to say gunmen were in the store, Los Angeles police Lt. Andy Neiman said. "She told him: 'Call 911. Two guys with guns just came into our store,'" Neiman said. Police officers and SWAT team members swarmed the outdoor shopping center that also has restaurants and a theater. The officers saw a man leave the second-floor store, but he ran back in, Neiman said.

NASA Turns Astronaut Trash Into Space Radiation Shield

Humans produce trash just about everywhere they go, including space, which will pose a problem for astronauts on long voyages to other planets. But scientists have found a way to transform this space detritus into something useful: a radiation shield. Since flinging garbage out the door is not an option, engineers at NASA are testing how a novel on-board trash compactor could give new life to discarded water bottles, clothing scraps, duct tape and other waste on deep-space missions. The space trash compactor is not like the giant one on the Death Star that nearly squashed Luke Skywalker and the gang in the first "Star Wars" film. This one is smaller, producing circular tiles of trash 8 inches (20 centimeters) wide and a half-inch (1.3 cm) from a single day's worth of garbage. The discs then could be stowed away, or even used for radiation shielding to protect a spacecraft’s crew, NASA officials said.

Ground search ends for skydiver missing in Wash.

NORTH BEND, Wash. (AP) — The ground search for a Florida skydiver who vanished during a jump above Washington's Cascade foothills ended Sunday without a sign of the man. The King County sheriff's office said crews combed roughly 9 miles of an area near Mount Si for 29-year-old Kurt Ruppert but that the air search would continue. The Lake City, Fla., man hasn't been seen since he jumped out of a helicopter at 6,500 feet on Thursday. He was wearing a special wing suit with fabric under the arms to allow him to glide like a flying squirrel. The jumpsuit is brown and green, which will likely blend into the terrain. Crews narrowed their search area Saturday, based on data from Ruppert's cellphone and the helicopter's flight path.

Bluefin Tuna Sells for Record number

Japan was abuzz after a prized bluefin tuna weighing 489 pounds was sold for a record $1.76 million at the first auction of the year at Tokyo's Tsukiji fish market on Saturday. Kiyoshi Kimura, who is president of Kiyomura Co. and the Sushi-Zanmai sushi restaurant chain, bought the massive fish at $3,600 per pound. Let's repeat that, shall we? 2013: Talk Gets Cheaper, TV Gets Smarter

Personal technology never stops changing. Some new products and services are game changers, like Apple's (AAPL) iPhone and iPad. Others are clever twists or refinements, like each successive version of Google's (GOOG) Android platform, which gets better and better. Others are bold gambles, like Microsoft's (MSFT) new Windows 8, which hopes to combine both a tablet experience and a traditional PC environment in one operating system. But there's always something new, from large companies and small ones. So here are a few things consumers will likely see in technology in 2013. Many of these began to take shape in the past year, but will be stronger trends in the new year. Another trend I expect to see in 2013 is an expansion of apps and devices that let people wirelessly control many everyday objects, from light bulbs to appliances, using low-powered networks and smartphones or tablets. And we'll likely see more smart devices with such intelligence built in, similar to the Nest intelligent thermostat, which is Wi-Fi powered. These are just a few of the trends likely to mark the consumer tech landscape in 2013. Others will also be prominent, most notably the continued reliance on the cloud, or remote servers, to store content and work collaboratively. One thing is sure: There are certain to be developments that will surprise us all, and can't be forecast here.
